Buzzkill be gone. If you’ve ever wondered why your “penny refills” felt like a legal loophole, it’s because they were. For over 20 years, “bottomless” drink promotions have been technically illegal in Texas under TABC Administrative Rule 45.103. But that’s all about to change.
In a rare show of bipartisan support, the Texas House of Representatives passed H.B. 1100—the “Orange You Glad It’s Brunch Act 2026”—with a 142-8 vote. The new law officially clears the way for businesses to offer all-you-can-drink promotions just in time for the summer crowds.

Preparing for the World Stage
The timing isn’t a coincidence. With the 2026 World Cup expected to bring over a million tourists and billions in economic impact to Texas metro areas, state officials are looking to make the region as attractive as possible to global visitors.
“The least we can do is give our guests their money’s worth,” said Texas Rep. Randy Bubbles. “It’s called ‘Southern Hospitality.’”
The measure, which goes into effect June 1, 2026, effectively strips the TABC of its power to regulate “undetermined quantities” of sparkling wine or specific champagne-to-juice ratios.
More Than Just a Weekend Trend
While the bill is a major win for the tourism industry, lawmakers emphasize that it’s a victory for local Texans as well—from bachelorette parties to influencers looking for the perfect patio shot.
“This bill isn’t just for tourists; it’s for the people of Texas,” said lawmaker Andre “O.J.” Flute. “It’s a victory for the hangover survivors who will be alright with just one more Bloody Mary.”

Brunch Any Day of the Week
Perhaps the most surprising part of the bill is its flexibility. Bottomless promotions won’t be restricted to Saturdays and Sundays. Starting June 1, businesses can legally offer these deals every day of the week, paving the way for “Mimosa Mondays,” “Turn Up Tuesdays,” and beyond.
